The Federal Republic of Nigeria, 1999 (as Amended) Constitution’s Section 6 outlines the structure and authority of the judiciary in Nigeria. There are three different government bodies. They are the Judiciary, the Legislative, and the Executive. There are elected representatives of the Executive, Legislature, and judiciary among the three branches of government. The judiciary is viewed as the last refuge of the common man around the world. This assumes that it is the only location where the average person may find justice! If the average person cannot access justice in the courts, the judiciary will fail miserably, and society will undoubtedly suffer as a result. This is how the judiciary and dishonest politicians get along. Bola Ahmed Tinubu was declared as the 2023 presidential candidate without satisfying the constitution rights. The Independent Electoral Commission chairman, Prof. Mahmood Yakubu fraudulently declared him. This was against the wishes of the masses. This in turn establishes a “Cabalism Theory” of Islamizing and marginalizing certain individuals and poses doom to democracy in the country. In this paper, I examined the disaster this can cause democracy in the country.
