国家豁免是一项国际法的基本原则,具有国际法和国内法的双重属性。限制豁免无论是从国际法还是从各国国内法的角度来看,都远未形成国际社会普遍接受的统一规则。中国的国家豁免政策选择需综合考虑中国特殊的政治、经济和外交需求后,做出对中国国家利益最大化的选择。“百年未有之大变局”下的当今国际社会正在发生剧烈的政治和经济变迁,采纳限制豁免将导致中国既不能在国际斗争中有效对抗敌国,又不能在国际合作中充分团结友邦,且副作用极大,无论是在国际政治斗争还是国际经济合作层面、无论是在应对和反制境外涉华诉讼还是在主动受理对外国国家的诉讼层面,都是当代中国在“国家豁免政策选择评价矩阵”四象限中的最差选项,绝对豁免相对而言则具有压倒性的政策优势。限制豁免对当代中国而言是一场“开弓没有回头箭”的历史豪赌,中国应尽量避免于近…[Read more]

近年来,美西方国家频繁出现以新冠疫情追责为代表的利用限制豁免在外国法院针对中国的滥诉案件,这种案件的处理包括应对和反制两个方面。中国一直以来坚持绝对豁免,若当代中国转为限制豁免,在此类案件的处理上会出现如下情况:在第一阶段不但同中国当前应对“新冠疫情诉讼”的外交实践相矛盾,还会导致美西方对中国的滥诉在话语权层面由“绝对违法”变成“相对违法”,为美西方干涉中国内政提供了法理依据和政治操弄空间;在第二阶段使中国案件应对的话语权由“绝对有理”变成“公说公有理、婆说婆有理”,给案件的处理平添了重大的不确定性,为美国在国际社会炒作并抹黑中国留下可乘之机;在第三阶段导致中国采取的反制措施的合法性被削弱甚至消除,使中国的反制措施从“绝对正义”变成“相对正义”,而且其反制效果在经济、政治和外交层面都差强人意…[Read more]
